What To Know Before Handling Your Own No-Fault Claim

New York is a No-Fault State. If you are injured in a car accident, no matter who is at fault, you are entitled to compensation for medical bills, lost wages, transportation costs, household help, and out-of-pocket expenses relative to your injury. Directly after your accident, it’s imperative that you file a No-Fault claim and submit your application within 30 days of your accident in order to receive these benefits. The No-Fault application can be difficult to fill out properly, especially after a serious injury has uprooted your life. Here’s a brief guide on how to fill out the No-Fault application. However, you only have 30 days from the date of your accident to file your application. In case you are filing your No-Fault application alone, we think it’s important that you understand what you should do in order to ensure you receive the No-Fault benefits you are entitled to.

What To Do When You’re Handling Your Own No-Fault Claim

  • Notify your insurance company that you were injured in an accident as soon as possible. If you are unable to do so, have a relative inform them.
  • Make sure you file your No-Fault application as soon as possible, no later than 30 days from the date of your accident. If you are unable to do so, have a relative file the form.
  • Make sure your physician has a detailed description of your accident as well as any pain you have experienced since your accident.
  • Keep track of the out-of-pocket expenses you have spent on transportation to and from medical appointments, whether it is a taxi service or mileage on your car. If you require household help, make sure you keep receipts for any hired assistance. You must submit this information to your insurance carrier within 90 days of the date you received said service.
  • Gather all medical bills and prescription receipts relative to your injury and submit these documents to your insurance carrier within 45 days of your treatment.
  • If you are unable to work due to the injuries you’ve sustained, have your physician write you disability notes every 30 days and submit these to your insurance carrier each time you receive one.

You are entitled to a degree of compensation for these costs associated with your injury. It’s imperative that you submit this information to your insurance carrier within the above-stated timetables or you may risk denial of coverage.
