Nassau County Uber and Lyft Accident Lawyers

Experienced Rideshare Accident Attorneys in Nassau County, NY

nassau county rideshare accident attorneyUber and Lyft ride sharing has become more and more popular since its introduction over a decade ago in the United States. Nassau County is no exception. Many people decide to use either Uber or Lyft to get to and from work, school and even social events. As a result of the growing use of ride sharing services in Nassau County, we have seen a fair share of collisions involving cars in the process of ride sharing. If you have been injured in an Uber accident or Lyft accident in Nassau County you may have some questions about how to proceed. Who is going to pay your medical bills? How will you get your lost wages reimbursed? And, are you entitled to compensation from either Uber or Lyft? Palermo Law’s Nassau County Uber and Lyft Accident Lawyers can answer these questions for you.  The fact is that both Uber and Lyft require their driver’s to procure insurance to cover individuals injured in car accidents as either a passenger of the ride sharing vehicle or an occupant of a vehicle injured by a ride sharing driver. However, there are some things you need to know in order to pursue a claim properly.

Uber and Lyft Provide No-fault Benefits

If you are a passenger in an Uber or Lyft and are injured during a ride you are entitled to receive no-fault benefits from that vehicle’s no-fault insurance carrier. No-fault benefits will cover your medical bills and lost wages. However, it is important to file a claim with the proper insurance carrier within 30 days of your crash. This is not always easy to do since you may not know which insurance company covers the ride sharing vehicle you were occupying. The best way to find this information is to make sure you get a copy of the police accident report. The insurance carrier will be listed by its DMV code on that report. The code can be easily looked up online to find the corresponding insurance company.

It is also a good idea to file a no-fault claim with your personal vehicle’s insurance carrier. Even though the ride sharing vehicle you were in at the time of the collision is the primary source of no-fault benefits, it is possible that your car insurance carrier may provide additional benefits. For example, you may have enhanced coverage for lost wages available through your personal vehicle’s no-fault coverage.

If you were in a vehicle that was struck by either an Uber or Lyft vehicle, you will need to file a no-fault claim with your insurance carrier for benefits. In New York, the vehicle that you are occupying at the time of the collision is always responsible for providing no-fault benefits regardless of who was at fault for the car crash.

Compensation for Injuries

If you were injured in an Uber or Lyft car accident in Nassau County, you may also be eligible for compensation from the responsible party. New York has a threshold law with respect to injuries suffered in car crashes. That means that you need to have sustained a serious injury to be eligible to recover compensation. Sometimes it is obvious if you’ve suffered a serious injuries. Other times it is more complicated. The best way to determine if you are eligible for compensation is to speak to a qualified Nassau County Uber accident lawyer or Lyft Accident lawyer.

In that time, we’ve pretty much seen and done everything there is to do when it comes to car accident litigation. Important Deadlines for Uber and Lyft Accidents

There are a few important deadlines to keep in mind if you are injured in an Uber or Lyft accident in Nassau County. First, you only have thirty days to file a no-fault application with the proper insurance company. Failing to do so within thirty days could result in you getting stuck with expensive medical bills. Also, it is important to know that the no-fault application must be filed in writing. It is not enough to report the crash over the phone. You should always mail your application certified mail. If you are filing your application online, make sure to retain proof of your submission.

Another deadline to keep in mind is the statute of limitations. Generally, you have three years to file a law suit as a result of a car collision. But in certain instances that amount of time can be reduced to as little as 90 days if the responsible party is in a municipally owned vehicle. Further, not all municipal vehicles are marked as such. So, it’s always a good idea to hire a lawyer to examine the ownership of all vehicles involved in your accident to ensure that there are no missed statutes.
