Lost Wages After A Pedestrian Accident In Huntington

Similar to your medical bills, your lost wages are also reimbursed by no fault insurance. However, there are some caveats. First, lost wages through no fault are general capped at 80% of your salary up to $2,000 per month. So, if you earn more than that amount, you will receive the maximum allowed by no fault of $2,000 unless you have purchase enhanced no fault coverage known as (APIP or OBEL). If you have purchased that extra protection, you may be able to receive additional lost wages above $2,000. 

Since your primary source of no fault coverage in a pedestrian accident is the insurance company of the vehicle that caused the accident, you can also file a second no fault application with your company if you have enhanced coverages. In cases like that, the other party’s insurance carrier will pay the first $2,000 and your carrier will pay any additional lost wages that you are entitled to receive.

In order to get lost wages, you will need to fill out a no fault application with the proper insurance carrier within 30 days of your accident and you will need to provide a disability note from a treating physician along with wage verification from your employer. Of course, dealing with these forms can become very complicated. Therefore, it’s always a good idea to speak to a lawyer to learn your rights.
